    Terms of Service

    Terms of Service last revised: September 10th, 2011

    YOU MUST READ AND UNDERSTAND THE FOLLOWING BEFORE ORDERING ANY PRODUCT OR SERVICE, FREE OR PAID.

    "We", "Us", "Our", is referring to HostmyHeart.com. "You", "They" is referring to the client, free or paid member of Hostmyheart.com's services.

    By joining HostmyHeart.com as a free / paid member, you agree to the following:

    Illegal, harmful and Unacceptable

    The service provided to you (free or paid member of HostmyHeart.com) by HostmyHeart.com is to be used for lawful purposes only. Sharing, storing or providing any copyrighted or trademarked material, personal or financial data, or otherwise any such material that violates any United States laws (Federal, state, city) is prohibited. This includes but is not limited to copyrighted files (of any format) and child pornography. You are not to upload, share, link to, or otherwise house illegal materials, materials harmful to the server, harmful to other members and other servers, and anything we deem unacceptable.

    You agree that HostmyHeart.com and it's administrators, volunteer staff, and any third parties involved to make the service possible, hold no fault and hold us as unaccountable for any legal claims or actions that may occur or be taken against you, if in violation or questioned on violating any United States law.

    Even if you are NOT LOCATED on United States ground, you are still responsible for abiding by all United States of America's laws.

    Illegal, harmful and otherwise unacceptable materials include, but are not limited to:

    • Any copyrighted files not belonging to you (music, movies, television shows, designs, photos, art, etc)
    • Sensitive or financial data (credit card numbers, passwords, bank account info, etc)
    • Adult content, child pornography (sharing, uploading, using on-site or linking to)
    • Fraud, spam and phishing websites
    • Warez and hack programs (sharing, uploading, using on-site or linking to)
    • Obscene or harmful material such as racism
    • Torrents, torrent-related files (sharing, uploading, using on-site or linking to)
    • Cracked / nulled scripts (sharing, uploading, using on-site or linking to)
    • Streaming or hosting video files, copyrighted or not
    • IRC and IRC related files
    • Proxies
    • Make Money websites, sites that exist solely to house ads
    • How to obtain, sell, trade, create, grow illegal substances and pharmacuticals
    • Scripts or code no longer being developed (scripts older than three years with no updates are considered End of Life and are not allowed)
    • Spam mail websites, sending mass spam mail
    • Any website with intent on using provided space for malicious purposes

    You can upload and share music and other materials that you've created yourself, is under a creative commons license or under the public domain.

    You can have your own ads (provided that you are not on the free Crush plan) like (Google Adsense, Chitika, Yahoo, etc), so long as they are not advertizing any of the above, or attempt to spread code harmful to the servers (viruses, worms, trojans) other customers' computers or other servers in no relation to HostmyHeart.com.

    If found with harmful, illegal or unacceptable materials including materials that affect HostmyHeart.com servers, members or other servers and people, HostmyHeart.com has the right to suspend or terminate offered services without notice.

    If found with illegal materials in violation of any United States law, we will report to the proper authorities.

    Account Related

    You are allowed one (1) free account per person, to prevent abuse. If we suspect that you have more than one account, we hold the right to suspend or terminate all of your accounts without notice.

    Accounts are activated manually. Please give us at HostmyHeart.com up to seventy-two (72) hours to activate your account. If your account isn't activated within 72 hours, send a support ticket at the Helpdesk or speak to us on live chat at the bottom-right of your screen.

    You agree to back up your website and data on your own. HostmyHeart.com backs up data once a week, but makes no garentee of successful data restore or recovery in the case of hardware, software or any other unexpected failure.

    You agree to not create accounts that you will not use, or create accounts for file storage. These types of accounts use up resources.

    Free (Crush) accounts with bandwidth usage of 1mb (megabyte) or less, or no activity, for a total of three (3) consecutive months will be considered inactive. If that is the case, the account owner will receive a notice of deletion, giving them a week to update or respond. The free (Crush) account in question will then be terminated if no action is taken after a week.

    Excessive CPU usage is not allowed. Some of the following are examples:

    • Chat applications, use a remotely hosted chat application instead
    • Unattended server-side processes
    • Web spiders or indexers
    • Cron entries running at intervals of 20 minutes or less
    • Mirror sites
    • Sending out mass spam emails

    If you want to cancel your account, or transfer a domain away from us, contact us at the Helpdesk under the category "Domains" or "Cancellation". There is no form for this.

    Age and Verification

    In accordance with United States law, as a free / paid member, you MUST be at least thirteen (13) years of age. If under eighteen (18) years old, you MUST have a parent or legal guardian look over the Terms of Service, agree to all policies and sign up for you. This is required by United States Law.

    Members who want to donate or upgrade to the paid package MUST be eighteen (18) years or older. If not age-appropriate, the minor must have a parent or legal guardian read and agree to the Terms of Service snd sign up for you. The parent or guardian will then claim liability for ensuring that the minor follows all rules and regulations. HostmyHeart.com will not be liable or claim fault for any illegal materials, unacceptable materials and otherwise any harm caused by the minor in question.

    You, as a member (free or a paid), or legal parent / guardian of one, agree to provide accurate, updated personal information. If you need to update your information in our customer database, contact the Support Helpdesk under the "Update my Info" category.

    If we feel there is something suspicious with your order (such as your IP pointing to Mexico and your address says you're in New York, as an example) or we feel there is an inaccuracy, we hold the right to deny service or inquire further through email or a phone call. Please use correct and updated information upon ordering.

    Domains

    Domains registered by HostmyHeart.com belong to us. Hostmyheart.com purchases domains from Namecheap.com at discounted prices, and in bulk. You receive a free WHOIS Protection for each domain ordered through us, to protect privacy. If you want to move to a different hosting provider, we will pass the domain to you, only if requested, free of charge.

    If your account goes inactive and gets terminated, violates a rule in our Terms of Service and leads to account termination, or breaks a United States law, we keep the domain.

    When ordering a domain from us, it's up to you to ensure that the domain you want is NOT already taken. When you order a domain from HostmyHeart.com, you will get an invoice sent to your email. When you pay the $10 USD flat fee for the domain, we will point it to the hostmyheart.com server.

    Be patient. It might take several hours before the domain is propogated through the internet, and shows up.

    When it's time to renew the domain a year later, you will receive an invoice ten (10) days in advanced. The invoice will be sent out ten (10) days before the original date of the domain purchase, a year later.

    Failure to provide payment on your domain on the day payment is due could result in domain expiration. If your domain expires, we can't do anything for you.

    Billing and Payments

    Free members are, well, free. You have no payments to make unless you ordered a domain from us, or you donated.

    Hostmyheart.com displays money in USD (United States Dollar). We accept PayPal as our payment processor.

    Refunds

    We do not offer refunds for domain names.

    We do not offer refunds for donations. Since, they're donations. Donations are given as a way of expressing how much you enjoy a product or service.

    We do not offer refunds for any physical products we might display on the website. We might display physical items for sale on HostmyHeart.com from time to time. The money used to purchase these items go straight into server costs.

    We offer a fifteen-day (15) refund policy for the Love (paid) hosting plan. This applies to new and upgraded accounts.

    General Liability

    You hold HostmyHeart.com, administration, volunteer staff, and any third parties that make the services at HostmyHeart.com possible- unaccountable for dataloss, legal claims against you, server downtime, account downtime, or illegal activites. We hold no responsibilities for the uses our members make with their accounts. If questioned by authorities, we will terminate the customer's account in question, and fully cooperate with said authorities.

    Hostmyheart.com administration holds the right to refuse services if you do not comply with the above Terms. HostmyHeart.com holds the right to change or modify the hosting plans and services without notice. Hostmyheart.com holds the right to revise the Terms of Service without notice.
